Post Judgment Payment Agreement


One of the main instruments that the creditor can use to collect from you is a salary trim. If the creditor has received a judgment from a court that you have money, the creditor can file documents to fill (taken or withhold) part of your paycheck to settle your debts. If this has happened, you will receive a copy of a profit withholding order (WG-002 form). But the creditor will be limited in the amount he or she can take. As a general rule, about 25% of your carry-up allowance is withheld, but the creditor cannot take care of the part of your paycheck that you need to support yourself and your loved ones. There is no provision excluding regulated agreements from that power. There is no point in the creditor imposing a sale if the fair value of the property is not much higher than the cost of the creditor. These costs include all of the above-mentioned costs, as well as the payment of the farm exemption and all previous mortgages and pawns that precede the judgment as a priority.
