One of the main instruments that the creditor can use to collect from you is a salary trim. If the creditor has received a judgment from a court that you have money, the creditor can file documents to fill (taken or withhold) part of your paycheck to settle your debts. If this has happened, you will receive a copy of a profit withholding order (WG-002 form). But the creditor will be limited in the amount he or she can take. As a general rule, about 25% of your carry-up allowance is withheld, but the creditor cannot take care of the part of your paycheck that you need to support yourself and your loved ones. Whether the Tribunal will apply a clause that may charge interest at the contractual rate on the principal amount due after and before a judgment does not appear to have been considered in Scotland. There is no provision excluding regulated agreements from that power. There is no point in the creditor imposing a sale if the fair value of the property is not much higher than the cost of the creditor. These costs include all of the above-mentioned costs, as well as the payment of the farm exemption and all previous mortgages and pawns that precede the judgment as a priority. In addition, complications resulting from the exemption and withdrawal fees from the farm will not make this type of sale very attractive to potential bidders.
